Terms of Service

1. Acceptance of these terms

These Terms of Service (“Terms”) form a binding agreement between you and MXH Technologies, Inc., a New York S-Corporation doing business as Family Butler (“Family Butler”, “we”, “us”). By creating an account, accessing the dashboard at ourbutler.ai, or interacting with the Butler assistant in a connected family chat, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the service.

2. The service

Family Butler provides a personal AI assistant (“Butler”) that joins your family group chat and helps with the operational logistics of running a household: schedule coordination, briefings, reminders, meal planning, light email and calendar triage, household research, and (when you ask for them) purchases and outbound voice calls on your behalf.

Butler is an assistant. It is not a healthcare provider, financial advisor, attorney, emergency service, or substitute for human judgment in any high-stakes decision. You are responsible for reviewing and approving anything Butler proposes before you rely on it.

3. Eligibility

You must be at least 18 years old and able to form a binding contract under U.S. law to use Family Butler. The service is currently designed for adult primary caregivers in a household; accounts are intended to be used by parents or other adult heads of household. You agree to provide accurate information at signup and to keep it up to date.

4. Your account

You are responsible for maintaining the confidentiality of your login email and any device you stay logged in on. You are also responsible for any actions taken through your account, including any actions Butler takes on your authorization (such as creating calendar events, sending messages, or placing orders). 5. Subscription, free trial, and billing

Family Butler is offered as a paid subscription:

  • Free trial. New families start with a 14-day free trial. A valid payment method is required at signup. You will not be charged during the trial period and you can cancel at any time before it ends to avoid any charge.
  • Base subscription. $20 per month per family, billed monthly in U.S. dollars to the payment method on file.
  • Usage-based overage.The base subscription includes a generous monthly allowance of AI processing. If your household’s usage exceeds that allowance, the excess is billed at our cost plus a 5% margin. You can set a hard monthly cap on overage in your settings to prevent surprise charges.
  • Bring your own key (BYOK). If you supply your own Anthropic API key, AI processing costs are billed directly to your Anthropic account and are excluded from our overage calculation. Tool-use costs (such as web search) remain billed by us.
  • Cancellation. You can cancel at any time via the Stripe Customer Portal linked from your Billing page. Cancellation takes effect at the end of the current billing period, and you will retain access until then. We do not offer refunds for partial billing periods.
  • Failed payments. If a payment fails, we will notify you and pause the service after a reasonable grace period.
  • Price changes.We may change pricing on at least 30 days’ notice. Continuing your subscription after the notice period means you accept the new pricing.

Subscription billing is processed by Stripe. By subscribing, you also agree to Stripe’s terms.

6. Acceptable use

You agree not to:

  • Use the service for any unlawful purpose
  • Use Butler to harass, threaten, defraud, or harm any other person
  • Attempt to extract, reverse-engineer, or train another model on Butler’s outputs or system prompts
  • Probe, scan, or test the vulnerability of the service or our subprocessors without prior written permission
  • Interfere with or disrupt the service, our servers, or any subprocessor’s infrastructure
  • Use Butler to make decisions that legally require licensed professional judgment (medical, legal, financial, etc.)
  • Use Butler to send spam or unsolicited messages
  • Resell, sublicense, or otherwise commercialize the service without our written permission

We may suspend or terminate your account if we reasonably believe you have violated these rules.

7. AI limitations

Butler uses large language models, which can make mistakes, hallucinate facts, misunderstand context, or produce content that is biased, offensive, or simply wrong. You should treat Butler’s output as a draft for your review, not as a final answer. You retain sole authority and responsibility for any action you take in reliance on Butler’s suggestions, including but not limited to purchases, calendar changes, communications with third parties, and decisions that affect your family’s health, finances, or safety.

8. Third-party services

Family Butler integrates with third-party services including Google, Stripe, Anthropic, Blooio, Resend, Brave, OpenWeatherMap, Google Maps, LiveKit, and others (see our Privacy Policy for the full list). Your use of those services is also governed by their own terms and privacy policies, and Family Butler is not responsible for their actions, availability, or policies.

9. Intellectual property

Family Butler retains all rights, title, and interest in the service, the dashboard, and the Butler software, including all improvements and derivative works. You retain ownership of any content you provide to the service. You grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and transmit your content solely as necessary to operate the service for you.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, ACCURATE, OR SECURE, OR THAT BUTLER WILL PRODUCE ANY PARTICULAR RESULT.

BUTLER IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL, LEGAL, FINANCIAL, OR EMERGENCY SERVICES. IN A LIFE-THREATENING EMERGENCY, CALL YOUR LOCAL EMERGENCY NUMBER.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAMILY BUTLER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID TO US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) ONE HUNDRED U.S. DOLLARS.

12. Indemnification

You agree to defend, indemnify, and hold harmless Family Butler and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including reasonable attorneys’ fees) arising from your use of the service in violation of these Terms or applicable law, or from any content or instruction you provide to Butler.

13. Termination

You may stop using the service at any time and cancel your subscription via the Stripe Customer Portal. We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms, if required by law, or if continuing to provide the service is no longer commercially viable. The handling of your data on termination is described in our Privacy Policy.

14. Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in New York County, New York, and you and Family Butler consent to the personal jurisdiction of those courts.

To the maximum extent permitted by law, you and Family Butler each waive the right to a jury trial and agree that any dispute will be resolved on an individual basis only and not as part of a class, collective, or representative action.

15. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will notify you by email and in the dashboard at least 30 days before they take effect. Continuing to use the service after changes take effect means you accept the updated Terms.

16. Miscellaneous

These Terms, together with our Privacy Policy, are the entire agreement between you and Family Butler regarding the service. If any provision is found unenforceable, the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
